Tax Treaties and Non-Resident Professional

Treaty exemption requires the applicable agreement’s conditions, not merely a short engagement.

Source checked · 11 October 2026

Key Requirements

Use IRAS’s current-engagement DTA calculator and the treaty text. Where exemption applies, the professional completes and signs IR586 and gives it to the payer, who claims the exemption in the withholding filing. The form is retained rather than routinely submitted, unless IRAS requests it. For multiple visits under a contract, the page directs the claim after completion when total physical presence is known. Prior-year situations should follow the instructed enquiry route. If no treaty exemption applies, the payer must file and remit withholding by the ordinary deadline.

Use the Treaty Tool for the Correct Engagement

Start with the professional’s treaty jurisdiction and the particular engagement, rather than assuming that every visitor from a treaty country is exempt. The qualifying conditions must be met under the applicable agreement. IRAS directs current engagements to its DTA calculator and prior-year cases to its enquiry route, so preserve the engagement dates and use the appropriate process for the year being reviewed.

For a contract involving several visits, keep one cumulative physical-presence schedule linked to that contract. The official FAQ says to claim through Form IR586 after contract completion when total presence is known. Looking at only one short visit can give an incomplete result if later visits change the qualifying facts. A practical file should retain the contract, travel schedule and calculator result together.

Give the Payer the Evidence for Its Filing

If the calculator result indicates exemption, the professional completes and prints the displayed IR586 and gives it to the payer. The payer claims the treaty exemption when e-filing withholding tax on the professional’s behalf. IR586 is kept to support the claim and supplied to IRAS if requested, rather than routinely sent with every filing. If exemption does not apply, filing and payment obligations remain. This process separates eligibility evidence from the payer’s actual tax submission; a completed calculator alone is not the payer’s filed return.
