Prepare Evidence for the Correct Cessation Event
Identify whether the event is a resignation or a disqualification before choosing supporting documents. For resignation, ACRA lists the resignation notice and either the board’s acknowledgement or evidence that the registered article was received. Disqualification may instead require a bankruptcy statement, court order or other supporting evidence. A disqualified director must also give the company written notice. Keep the event date and the affected company clear: someone leaving several directorships needs a separate notice for each company, rather than one notice covering all appointments.
Follow the Notification Through to Its Outcome
The normal company route is withdrawal of the position holder within 14 days of the event. A director may notify ACRA immediately if there are no other officers who can file, such as when the secretary has resigned and other directors are disqualified. After filing, ACRA says the notification status can be checked after one to three days through Transaction Status Enquiry or the supplied email address. Straightforward cases may be approved immediately; further review can take 20 working days and ACRA may advise that more time is needed. Do not treat a submitted resignation letter as confirmation that ACRA’s records have changed.
