Prepare the Charge Instrument and Lender Details

As practical preparation, record the creation date, execution location and whether the charge existed before re-domiciliation before calculating the deadline. The 37-day rule is identified for specified overseas statements, rather than every transaction involving an overseas party. A different route may be needed for property acquired subject to an existing charge or debentures issued in separate series.

For a particulars filing, prepare the borrower’s UEN, the instrument evidencing the charge, any trustee and at least one chargee. Corporate lenders require entity details; foreign corporate lenders also require their home jurisdiction and registration number. If the security does not cover all money owing, prepare the currency, secured amount and its description. Check the property description and restrictions against the actual instrument, rather than using only the loan amount.

If a court extension applies, have the court document number, order date, permitted period and order copy ready.
